These Terms and Conditions apply to the use of www.akgsoda.com and purchases from AKG SODA CENTER.
AKG SODA CENTER specialises in fresh, made-to-order drinks and beverages. Our menu is 100% vegetarian.
Because many of our products are freshly prepared, made to order and perishable, special conditions apply to cancellations, refunds, collection, delivery and packaging.
By accessing our website, creating an account, placing an order or purchasing from AKG SODA CENTER, you agree to these Terms.

Depending on the location from which you order, your transaction may be with the local AKG SODA CENTER company, franchisee, licensee or authorised operator responsible for that location.
2. OUR FRESH DRINKS
AKG SODA CENTER specialises in freshly prepared drinks and beverages.
Many of our drinks are individually prepared, mixed, blended or otherwise made specifically after a customer's order is received.
Our products may include sodas, fresh drinks, fruit-based beverages, mojitos, falooda, milk-based drinks, shakes, speciality beverages, desserts and other freshly prepared products.
Because our products are fresh and may be perishable, their taste, texture, temperature, appearance, carbonation, consistency and overall quality can naturally change over time.
For the best experience, customers should consume fresh drinks as soon as reasonably possible after preparation.
Fresh drinks should not be treated in the same way as sealed, shelf-stable or long-life packaged beverages.
3. 100% VEGETARIAN
AKG SODA CENTER is a 100% vegetarian food and beverage business.
Our menu is designed to contain vegetarian products. We do not intentionally use meat, poultry, fish or seafood as ingredients in AKG SODA CENTER food and drinks.
Our commitment to a 100% vegetarian menu is intended to apply across our AKG SODA CENTER locations internationally.
Ingredient brands, manufacturers and suppliers may vary between countries and locations.
We take reasonable steps to source ingredients and products consistent with our vegetarian menu and rely in part on information supplied by manufacturers and suppliers.
If a supplier changes an ingredient, formulation or manufacturing process without our prior knowledge, we will take reasonable steps to update our information when we become aware of the change.
VEGETARIAN DOES NOT NECESSARILY MEAN VEGAN
Some AKG SODA CENTER products may contain milk, dairy products or other ingredients that are suitable for vegetarians but may not be suitable for vegans.
Customers following a vegan diet should check individual product information or speak to our staff before ordering.
Being 100% vegetarian does not mean our products are allergen-free.
Customers with allergies, intolerances or specific dietary requirements should check the relevant product information and speak with the relevant AKG SODA CENTER location before ordering.
4. PRODUCT INFORMATION

Because many drinks and products are freshly prepared, there may be reasonable variations in:

If a product becomes unavailable after you order, we may contact you to offer a suitable alternative or provide an appropriate refund for the unavailable item.

7. FRESHLY MADE TO ORDER
Many AKG SODA CENTER drinks and products are prepared specifically for each customer after an order is accepted.
Preparation may begin shortly after your order is placed.
Once ingredients have been used and preparation has started, the product cannot normally be resold or reused for another customer.
For this reason, cancellations and change-of-mind refunds may be restricted once preparation has begun, subject always to applicable consumer law.
8. ALLERGIES AND FOOD INTOLERANCES
IMPORTANT: If you have a food allergy or intolerance, please check the available allergen information and contact the relevant AKG SODA CENTER location before ordering if you are unsure about any product.
Our products may contain or come into contact with allergens including:

• Gluten-containing cereals
• Soya
• Sesame
• Eggs
• Sulphites
• Other allergens depending on the product
Our locations may handle multiple ingredients in shared preparation environments.

Nothing in these Terms limits any legal responsibility that cannot lawfully be excluded.

11. COLLECTION ORDERS

Because your drink is freshly prepared, please collect your order as close as reasonably possible to the stated collection time.
If a customer collects an order significantly later than the stated collection time, the drink may lose:

• Temperature
• Carbonation
• Texture
• Consistency
• Appearance
• Intended taste or quality
Where deterioration results from an unreasonable delay in collection, AKG SODA CENTER will not be responsible for that deterioration to the extent permitted by law.
This does not affect your rights if the product was already faulty, unsafe or incorrectly prepared when it should have been supplied.
12. DELIVERY ORDERS
Delivery may be available at selected AKG SODA CENTER locations.
Delivery areas, charges, minimum order values and estimated times may vary.
Delivery times are estimates and may be affected by:
• Traffic
• Weather
• Distance
• Customer demand
• Road closures
• Driver availability
• Technical problems
• Circumstances outside our reasonable control
Freshly prepared drinks can naturally change during transportation.
Customers are responsible for providing complete and accurate delivery information.
Where available, customers should select our Special Takeaway Packaging for delivery orders to help protect the drink during transportation.
13. THIRD-PARTY DELIVERY SERVICES
Some orders may be placed or delivered through independent third-party platforms or delivery providers.
Where you place an order through a third-party platform, that provider's additional terms and policies may apply.
Third-party providers may independently control aspects of ordering, payment, delivery and refunds.
Issues specifically relating to a third-party platform may need to be raised directly with that provider.
14. REGULAR PACKAGING
Regular AKG SODA CENTER packaging is primarily intended for products that will be consumed at our location or immediately after preparation.
Regular packaging is not designed to provide the same level of protection for extended transportation or delayed consumption as our Special Takeaway Packaging.
If you intend to take your drink away, collect it for later consumption or have it delivered, you should select Special Takeaway Packaging where available.
15. SPECIAL TAKEAWAY PACKAGING
AKG SODA CENTER may offer Special Takeaway Packaging for certain drinks and products.
Special Takeaway Packaging is designed to provide additional protection during transportation and help maintain the product's:
• Freshness
• Taste
• Texture
• Temperature
• Appearance
• Consistency
• Carbonation, where applicable
• Overall quality
for longer than regular eat-in packaging.
An additional charge may apply for Special Takeaway Packaging.
Any applicable charge should be shown when you select the option or before checkout.
Special Takeaway Packaging is intended to help protect the product during transportation. It does not guarantee that a fresh or perishable product will maintain its original condition indefinitely.
16. CUSTOMER RESPONSIBILITY FOR PACKAGING
Where Special Takeaway Packaging is offered for collection, takeaway or delivery, customers are strongly encouraged to select it.
If you choose regular packaging instead of available Special Takeaway Packaging, you acknowledge that the product may deteriorate more quickly during transportation.
This may include changes to:
• Taste
• Freshness
• Carbonation
• Temperature
• Texture
• Consistency
• Appearance
• Overall product quality
To the extent permitted by applicable law, AKG SODA CENTER will not be responsible for deterioration caused by a customer's choice of unsuitable packaging, transportation after collection, unreasonable delay in consumption or improper storage.
This does not affect your mandatory rights if the product was faulty, unsafe, incorrectly prepared or otherwise did not comply with applicable law when supplied.
17. STORAGE AND CONSUMPTION
AKG SODA CENTER drinks are made fresh and should generally be consumed as soon as reasonably possible.
Customers should follow any refrigeration, storage or consumption instructions provided.
The taste, texture, temperature, carbonation and appearance of a fresh drink can naturally change over time.
Special Takeaway Packaging may help maintain product quality for longer than regular packaging, but it does not make fresh or perishable products shelf-stable or suitable for indefinite storage.
18. CANCELLATION POLICY
If you need to cancel an order, contact the relevant AKG SODA CENTER location immediately.
If preparation has not started, we may be able to cancel your order.
Once preparation of a fresh drink or food product has started, cancellation may not be possible because ingredients have already been used to prepare a product specifically for your order.
Change-of-mind cancellations after preparation has started will therefore not normally qualify for a refund, except where required by applicable law.
Nothing in this policy affects your mandatory consumer rights.
19. REFUND POLICY
AKG SODA CENTER wants every customer to receive the product they ordered in an appropriate condition.
Because our drinks and other products are freshly prepared, perishable and often made specifically for each customer, refunds are considered according to the circumstances of each order and applicable consumer law.
We do not normally provide a refund simply because a customer:
• Changes their mind after preparation has started
• Decides they no longer want the product
• Orders the wrong product, flavour or size
• Selects the wrong customisation
• Provides incorrect delivery or collection information
• Fails to collect the order within a reasonable time
• Leaves a fresh drink for an unreasonable period before consuming it
• Stores the product incorrectly
• Transports the product improperly after collection
• Chooses regular packaging instead of available Special Takeaway Packaging and deterioration results from that choice
• Does not personally like the taste of a correctly prepared product they ordered
This does not affect your legal rights where there is a genuine problem with the order.
20. WHEN A REFUND OR REPLACEMENT MAY BE AVAILABLE
Depending on the circumstances and applicable law, we may offer an appropriate replacement, partial refund or full refund where:
• You received the wrong product
• A paid item is missing
• Your order was not supplied
• The product was materially different from what you ordered
• The product was defective when supplied
• The product was unsafe or unfit for consumption
• The product was incorrectly prepared
• We cancelled your order after taking payment
• The product otherwise fails to meet mandatory consumer-law requirements
The appropriate solution will depend on the circumstances and your applicable legal rights.
21. HOW TO REQUEST A REFUND
If there is a genuine problem with your order, contact the AKG SODA CENTER location from which you ordered as soon as reasonably possible.

• Details of the problem
Where reasonably necessary to investigate the issue, we may ask you to provide photographs of the product and/or packaging.
If you reasonably believe a product may be unsafe, do not consume it.
Where reasonable and safe, please retain the product and packaging if we have asked to inspect the issue.
22. REFUND METHOD
Where a refund is approved, it will normally be processed through the original payment method or relevant ordering platform.
The time required for the money to appear in your account may depend on your bank, card issuer or payment provider.
Where an order was placed through an independent delivery or ordering platform, the refund may need to be processed according to that platform's procedures.
23. PERSONAL TASTE AND PREFERENCES
Our freshly prepared drinks can have distinctive flavours, spices, sweetness levels, textures and combinations of ingredients.
A customer's personal preference is different from a product being defective.
We do not normally provide a refund solely because a customer does not personally like the taste of a correctly prepared product they selected.
However, if your drink was prepared incorrectly or materially differs from your order, please contact us so that we can investigate.
24. CUSTOMISED DRINKS
Where customers select available customisations such as sweetness, ice, flavour, toppings, ingredients or other options, we will make reasonable efforts to prepare the drink according to those selections.
Customers are responsible for checking their customisation choices before placing an order.
A correctly prepared customised drink will not normally qualify for a refund solely because the customer later changes their mind about their selected options.
This does not affect mandatory consumer rights.
25. PROMOTIONS AND DISCOUNT CODES
AKG SODA CENTER may offer:

• Discount codes
• Special offers
• Loyalty promotions
• Competitions

You may not commercially copy, reproduce, distribute, modify or use our intellectual property without appropriate permission, except where permitted by law.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms removes mandatory consumer rights.
To the extent permitted by applicable law, AKG SODA CENTER will not be responsible for deterioration in a freshly prepared product that results from:
• Unreasonable delay in collection
• Unreasonable delay in consumption
• Improper storage
• Improper handling after collection or delivery
• Transportation after collection
• Choosing regular packaging instead of available Special Takeaway Packaging where that choice causes or contributes to deterioration
This section does not protect AKG SODA CENTER from responsibility where a product was faulty, unsafe, incorrectly prepared or otherwise did not meet mandatory legal requirements when supplied.
31. EVENTS OUTSIDE OUR CONTROL
Delivery, collection and other services may be affected by circumstances outside our reasonable control.
These may include:
• Severe weather
• Traffic
• Road closures
• Natural disasters
• Government restrictions
• Strikes
• Transport disruption
• Utility failures
• Supplier disruption
• Internet or telecommunications failures
• Other unforeseen events
Our responsibility in these circumstances will be subject to applicable law.

The local AKG SODA CENTER company, franchisee, licensee or authorised operator may be the contracting party for purchases from that location.
Additional local terms may be introduced where required.
37. CHANGES TO THESE TERMS
We may update these Terms and our Refund Policy from time to time as our products, services, locations, packaging, delivery arrangements, website or legal requirements change.

38. SEVERABILITY
